Fletcher & Lawson can advise employers and employees on all aspects of employment, from recruitment through to termination and any dispute that may arise.
In particular the Employment Division regularly advises on:
- Discrimination matters: Whether sexual, racial or by reason of disability and whether on recruitment, during employment or upon termination.
- Terms and Conditions of Employment: The terms of contract between the employer and employee should be reflected in a document which is legally binding, clearly understood by both parties and complies with all relevant legislation.
- Directors' Service Contracts: Fletcher & Lawson drafts service contracts for directors and other senior employees for a wide range of businesses.
- Corporate Governance: We can advise upon the implementation of recent recommendations on the conduct and remuneration of directors and corporate governance generally.
- Pensions: Fletcher & Lawson can prepare and review pension scheme documentation and provide advice to employers and trustees on their duties and responsibilities.
- Share Options and Other Benefits: Fletcher & Lawson can prepare and advise on all documentation and on all aspects of the regulatory, legal and taxation framework required to introduce any individual share option or any share option or share incentive scheme and profit or performance related pay.
- Health and Safety at Work: Employers have a duty to provide a safe working environment for all their employees. We advise on all aspects of health and safety legislation, can assist in effecting risk assessment for a business and in the preparation and implementation of a Code of Practice to fit the business.
- Disciplinary and Grievance Procedures: Fletcher & Lawson can assist in the preparation of relevant procedures for the business and provide advice on the operation of those procedures with respect to particular employees.
- Trade Unions and Worker Representation: We advise and assist on all aspects of Trade Union recognition and negotiation and in connection with any industrial dispute. We can also advise on the formation of worker's councils and other representative bodies.
- Termination of employment: Fletcher & Lawson can advise upon the manner of termination, the negotiation of a severance package and the enforcement of any post termination restrictions.
